Audio Software Company reFX Audio Software, Inc. Launches Massive Doe Actions in Connecticut

A software company from British Columbia, reFX Audio Software, Inc., recently filed the following two lawsuits in Federal District Court in Connecticut:

3:13-cv-00207-JCH reFX Audio Software, Inc. v. Does 1-145
3:13-cv-00322-JCH reFX Audio Software, Inc. v. Does 1-89

The complaints, which follow much the same formula of previous mass Doe infringement actions, allege that downloaders in a swarm illegally downloaded the company’s Nexus Software using BitTorrent.  If you recently received notice from your Internet Service Provider such as Comcast that a subpoena has issued seeking your information, you should contact us right away and we can discuss your options.

Summary Of Recent Copyright Severance Decisions

Malibu Media, LLC v. John Doe Subscriber Assigned IP Address 174.51.234.104,  2013 WL 3753436 (D.Colo. 2013)

Severance denied by Court which explained:

On balance, the Court finds that the information sought in subpoena is both relevant and necessary to Plaintiff’s interest in vindicating its valid copyrights through this litigation and the discovery sought herein. Defendant’s First Amendment right to anonymous file sharing is too slight to overcome this interest. Therefore, the Sony Music factors support enforcement of the subpoena.
